Facts and Claim of Liability:

On January 23, 2008 at approximately 4:33 p.m., infant plaintiff was a pedestrian walking northwest on Lafayette Avenue at the intersection of Hutchinson River Parkway when he was hit by an oncoming school bus owned by Little Lisa Bus Co., Inc., and driven by defendant driver. EMTs arrived on the scene and tried to treat him, but infant plaintiff was unresponsive. He was transported to Jacobi Medical Center via ambulance and remained in the hospital for the next couple of days. Hospital staff informed infant plaintiff’s parents that infant plaintiff sustained a laceration to the right side of his head (which required two sutures on the right side of his head by his ear) and a broken cervical bone. He also had blood in the area between his brain and his skull where he received the two sutures. Ultimately, infant plaintiff was discharged from the hospital on January 25.

Currently, infant plaintiff still suffers from headaches, soreness in his ankle, and nightmares regarding the accident.

Fitzgerald & Fitzgerald filed suit in Bronx County Supreme Court and successfully secured a settlement for $375,000.00.
