Shooting Victim Hits Motorcycle Rider

shooting victim hits motorcyclist

In a bizarre Bronx accident, a man who was sitting in a Dodge Avenger was shot by an unknown suspect. The shooting victim fled the scene, hitting a motorcycle rider and seriously injuring him, according to recent reports. The Wakefield incident began when the suspect fired at least nine rounds at the car, hitting the driver in the hip. Others in the car were not injured.

The shooting victim fled only to collide with a motorcycle on Nereid and Baychester Avenues. The driver of the car was taken to the hospital to be treated for the gunshot. He is expected to make a full recovery. The motorcycle rider, a 42-year-old man, was taken to a local hospital and treated for head trauma and facial injuries. He is in stable condition at this time.

No arrests have been made in the shooting case and no charges in relation to the crash have been filed against the driver at this time.

If A Driver Is In Danger, Is He Or She Responsible For a Crash?

While it does not happen frequently, there may be occasional cases in which someone is driving negligently due to perceived or real danger. For example, if a driver is being threatened with a gun, it is understandable that the driver might speed or swerve in and out of traffic to escape. However, while this behavior may be understandable, it does not necessarily relieve that driver from responsibility if he or she causes a crash.

Liability is the legal condition of being responsible for someone else’s injuries. Whether a driver “meant” to hit a victim is not a requirement for liability. The fact that the driver was acting carelessly or negligently is sometimes enough to establish liability, no matter what the driver’s intentions.

Of course, if someone else threatened the driver, causing him or her to drive erratically, this could shift the liability to the person making the threat. In this case, the victim might recover damages from that person.
