A hospital will pay $9 million to settle a medical malpractice case which led to an infant developing brain damage and cerebral palsy.

Here’s What Happened

The infant’s mother was taken to the hospital in September 2010. According to reports, the medical staff was well-aware of the mother’s medical history, particularly her increased vulnerability to uterine rupture.

The mother was treated by an inexperienced doctor who was in her first year of residency. When the mother’s uterus did rupture, the doctor failed to call for assistance.

Eventually, a nurse decided to call for help from a more experienced doctor.

Because of the delay in treatment, the flow of oxygen to the infant was disrupted, leaving him with brain damage and cerebral palsy.

He is permanently disabled and will require around the clock treatment and assistance for the rest of his life.

The Dangers of a Uterine Rupture

Essentially, a uterine rupture is a tear in the wall of the uterus that typically occurs during labor. Mothers who have previously given birth via C-section are especially vulnerable because the resulting scar tissue can give way from the stress of the contractions.

Is $9 Million Enough?

While $9 million is certainly a lot of money, it’s important to remember that just about every penny of that settlement will be used to provide help for this young boy for the remainder of his life.
