Settlement in New York Medical Malpractice Case Highlights Potential Problems with Assisted Living

When older people need assisted living, even for a temporary duration, several things can go wrong.  Certain situations can give rise to New York nursing home neglect cases and others can give rise to New York medical malpractice cases.  However, a recent case that wound up settling for an undisclosed amount shows how these two distinct theories of law can come together when a situation progresses and someone is badly injured as a result.

This New York medical malpractice lawsuit centers on The Jewish Home in Brighton, New York, which is located at 2021 Winton Road in Rochester.  The plaintiff in the lawsuit, Gertrude Kash, checked into the home for what was supposed to be a short stay to overcome some medical problems.  However, she was not properly catheterized and fell when getting out of bed one night after a bed alarm had not been set, and later she fractured a vertebrae with another fall that was not diagnosed.  She was paralyzed as a result.  The family filed the lawsuit, and the home has since reached a confidential settlement with the family after the original plaintiff passed away in 2009.
