Anyone who spends any time in New York understands that construction is a regular sight, even in a down economy. Unfortunately, the construction industry is one of the most dangerous in the world, and workers face this danger every time they report for work. Tragically, it seems that one man paid the ultimate price for a problem with concrete yesterday when a man was killed and three others were injured in a Queens construction accident.
According to reports, the first fatal Queens construction accident of 2011 occurred yesterday at approximately 9:30 a.m. at a construction site located at 84-18 Queens Boulevard in Elmhurst. A wall at the site collapsed, and it was believed to have occurred because the concrete for the wall was poured poorly. The site has had six previous violations since work started in June of 2009. The man who was killed as a result of the collapse was identified as 26-year-old Huberto Sanchez. Of the three men who were seriously injured, one was Mr. Sanchez' brother, Miguel. A city has issued a stop-work order as a result of the latest incident.

First and foremost, we'd like to offer our most sincere condolences to the family and friends of the man who was killed, and we hope that those who were injured are able to recover from the harm they have suffered. In addition, this Queens construction site accident may be the first of 2011, but every year there are several that occur across the city. On an annual basis, between 150 and 200 people are injured every year in New York construction accidents, and 7 people have been killed in 2009 and 2010.

Clearly, more information would be needed before a complete legal recommendation could be made. However, if it turns out that the men were not negligent in being where they were when the wall collapsed, it's possible that the family of the man who was killed and those who were injured could file different forms of New York personal injury lawsuits against those who were responsible for the pouring of the faulty wall. Such claims, if successful, could bring damages awards that compensate the family and the injured workers for their losses.
