Attorneys for Periventricular Leukomalacia Brain Damage - PVL Lawsuit

$15-million-dollar jury verdict for periventricular leukomalacia and cerebral palsy — brain injury to a child — hospital personnel delayed effective ventilation of premature baby, resulting in periventricular leukomalacia (PVL) and cerebral palsy

For over 30 years, the law firm of Fitzgerald & Fitzgerald has been committed to fighting for children with birth injuries, including periventricular leukomalacia (PVL).  In the case above, our birth injury lawyers represented a child who was born prematurely in a labor room that was not equipped and staffed to resuscitate a premature infant. Expert witnesses called by Fitzgerald & Fitzgerald testified that this departure resulted in a delay of effective ventilation and hypoxia, a subnormal concentration of oxygen (oxygen deprivation).  Fitzgerald & Fitzgerald successfully argued that the hypoxia, superimposed on the child’s premature birth, resulted in periventricular leukomalacia (PVL) and cerebral palsy.  The jury agreed and awarded our young client $15,000,000.  Read about our $15,000,000 case involving periventricular leukomalacia.

What is Periventricular Leukomalacia?

Periventricular leukomalacia is characterized by the death of the white matter of the brain due to softening of the brain tissue. It can affect fetuses or newborns; premature babies are at the greatest risk of the disorder. Periventricular leukomalacia is caused by a lack of oxygen or blood flow to the periventricular area of the brain, which results in the death or loss of brain tissue. The periventricular area-the area around the spaces in the brain called ventricles-contains nerve fibers that carry messages from the brain to the body's muscles. Although babies with periventricular leukomalacia generally have no outward signs or symptoms of the disorder, they are at risk for motor disorders, delayed mental development, coordination problems, and vision and hearing impairments. Periventricular leukomalacia may be accompanied by a hemorrhage or bleeding in the periventricular-intraventricular area (the area around and inside the ventricles), and can lead to cerebral palsy.
