New York Medical Malpractice Case Involves Transplant of Cancerous Kidney

When people donate their organs when they die, it's a good deed that's done for society.  Many consider it the ultimate gift to humanity, and organ donation has saved thousands of lives.  Tragically, it appears that the donation of a kidney to a man in New York actually cost him his life according to an ongoing New York medical malpractice lawsuit.  The case is currently at trial, and the man's surviving wife is suing those responsible for this cancerous kidney transplant.

According to testimony, Vincent Liew of New York needed a new kidney.  Fortunately, a match was found in Sandy Cabrera, who had died of a stroke.  Liew, who was 37 at the time, had the kidney implanted into his body.  For a short time, he seemed to be progressing well.  Tragically, two months after the kidney transplant, it was discovered that Cabrera had uterine cancer, and that the kidney that was used in the transplant could be tainted.

The Liew family's worst fears were realized only a few months later when Liew died.  What's worse is that the kidney used for Liew is not the only organ that was transplanted in other patients, even though it was discovered that Cabrera had uterine cancer during an autopsy that was performed soon after her death.  To this point, there is no evidence indicating why it could have taken so long to discover the serious danger in which Liew had been placed.

The crux of the case turns on both the alleged negligence for implanting cancerous organs and the decision by Liew and his doctor to leave the kidney in place even though he died of uterine cancer so soon thereafter.  It's likely that we won't know more about the case until it's over, as the judge has issued a gag order that prevents those involved with the lawsuit from discussing the case publicly.
