Birth injuries can happen for any number of reasons, but generally these situations arise when a mistake is made during childbirth, and these occurrences usually lead to some sort of New York medical malpractice lawsuit. However, recent news from the area has brought to light a new manner in which a birth injury allegedly occurred based on the claims of a woman in Queens. According to her allegations, she was treated in a brutal matter by police who reported to her apartment during a fight, and this conduct by police led to her giving birth to a stillborn child a few days later.
The woman was six months pregnant at the time, and she has filed a notice of claim with the city that could set the wheels in motion for a $5 million New York birth injury lawsuit. According to her account of the situation, the woman opened her door last month as a neighbor pounded on it after her apartment had been burglarized. The neighbor angrily accused the woman of committing the act, and the two got into a fight after repeated denials.
Police were called to the scene, and the woman claimed that she was forced to the ground on her belly and that her arms were pinned behind her back in handcuffs for approximately 10 minutes. Prior to being pinned to the ground, the potential plaintiff admitted that she attempted to strike the frenzied neighbor and mistakenly connected with the police officer, leading to her being subdued. The woman found out at a doctor's appointment four days after the incident that her unborn child had no pulse.
