Attorneys for Hydrocephalus Brain Damage

$25,575,000 jury verdict for hydrocephalus— Brain damage to infant — Failure to diagnose metabolic acidosis led to hydrocephalus and cerebral palsy (Case # 02170)

For over 30 years, the law firm of Fitzgerald & Fitzgerald has been committed to fighting for children with birth injuries, including those resulting from hydrocephalus.  In one case involving hydrocephalus, our client experienced respiratory distress after birth.  After an initial observation of signs of metabolic acidosis and a gradual increase of the oxygen saturation level, no blood-gas analysis was performed for 9 hours.  The resulting lack of adequate oxygen led to an intraventricular hemorrhage (bleeding in the brain) and hydrocephalus

Fitzgerald & Fitzgerald argued that the failure to properly monitor the infant client’s blood-gas level and failure to diagnose the metabolic acidosis when the first signs of the condition were evident resulted in hydrocephalus and permanent brain damage, including cerebral palsy, spastic diplegia, severe mental retardation, and deficits of our client’s fine motor skills and gross motor skills.  The jury awarded our young client $25,575,000. The jury awarded an additional $6,000,000 to the infant’s mother.

What is Hydrocephalus?

Hydrocephalus is a condition in which the primary characteristic is excessive accumulation of fluid in the brain. Although hydrocephalus was once known as "water on the brain," the "water" is actually cerebrospinal fluid — a clear fluid surrounding the brain and spinal cord.

Hydrocephalus may develop during pregnancy (congenital hydrocephalus) or at the time of birth or some point afterward (acquired hydrocephalus).  A timely diagnosis of hydrocephalus is important, and medical technology has provided a means to diagnose hydrocephalus during pregnancy.

Hydrocephalus Causes

As with most neonatal birth injuries, the causes of hydrocephalus are not well understood.  Although genetics can play a role, research supports the position that environmental and neurological factors are the primary cause of hydrocephalus.  Neurological factors that cause hydrocephalus can include cerebral hemorrhage (bleeding in the brain), brain tumor, bacterial infection, and brain trauma.  These neurological causes of hydrocephalus can be the result of medical malpractice.

If you retain Fitzgerald & Fitzgerald to represent your child, we will: 1) undertake an intense investigation of the medical history of your child; 2) consult with pediatric neurologists about your child’s hydrocephalus and resulting brain damage; 3) attempt to determine the cause of your child's hydrocephalus and resulting brain damage; and 4) if the hydrocephalus and brain damage could have been avoided, seek to recover compensation from the parties responsible.
