What Constitutes Hospital Malpractice/ Negligence?
Hospital negligence occurs when a hospital does not meet the accepted professional standard of competence, resulting in provable damages to the patient. A hospital is responsible for doctors, nurses, and other medical professionals employed by the hospital. In order to prove negligence, there must be testimony of an expert as to the acceptable standard of care that should have been applied to the situation and the expert must testify that the care that was given did not meet the criteria.
Below are some common situations that can give rise to a hospital malpractice/ negligence case:
- Birth injury or birth trauma
- Failure to diagnose
- Failure to monitor a patient
- Failure to order proper tests
- Failure to perform timely Cesarean (Caesarean) delivery
- Failure to treat an illness
- Failure to stabilize a patient
- Giving the wrong medication
- Improper use of anesthesia
- Improper use of a medical device
- Incorrect treatment of a diagnosed illness
