City Can't Be Liable for Policeman's Mistake in New York Pedestrian Accident

According to court records, this New York personal injury lawsuit stems from a New York pedestrian accident that occurred in 2006 at Herald Square.  Stella Lewis was walking towards Penn Station that day when she crossed West 34th Street with the light.  At that point, a police officer waved a bus through the intersection, and it hit her and caused permanent brain damage.  The resulting lawsuit was filed against the city, NYC Transit and the bus driver.  The court ruled that the case can proceed against the bus driver and NYC Transit.
