Facts: This action settled for $1,850,000 structured settlement at the start of jury selection. The infant Pltf. was delivered by a certified nurse midwife at Metropolitan Hospital. Meconium and a tight umbilical cord were noted at delivery and the child had Apgar scores of 0 at 1 minute and 0 at 5 minutes. The fetal heart monitoring tapes were never produced. Despite his depressed condition, he was not seen by a pediatrician until 15 minutes after his birth.

Pltf. claimed that the midwife failed to recognize fetal distress. She also claimed that inexperienced obstetrical residents negligently performed resuscitation, causing meconium aspiration. A medical malpractice panel found unanimously against Metropolitan Hospital.
