Facts:	Lawrence B. was a 68 year old retired railroad man. He slipped and fell on snow and ice on the sidewalk abutting a public school in Brooklyn. The New York City plows had pushed the snow and ice from the street up on the sidewalk. The school superintendent claimed that he had plowed the sidewalks clean and had created pathways through the mounds of snow to the street. Lawrence claimed that there was no path and that the sidewalk was not clear. He claimed that he had to walk over a mound of snow that went several feet on to the sidewalk.
