According to the New York Post:
"The Murray Hill high-rise where a beloved social worker fell to his death is rife with crumbling balconies that pose a deadly risk, residents fumed yesterday as the Department of Buildings considered a citywide inspection blitz.
Neighbors of Connor Donohue, the 24-year-old who plunged from the 24th floor after his railing gave way Sunday morning, blasted the ramshackle terraces.
"You can see the foundation crumbling. The railing is wobbly and insecure," said Carson Leven, 22, who lives a floor above Donohue's apartment at 330 E. 39th St. "The railing is loose; the side isn't even attached."
Residents are now forbidden to enter their balconies until the building owner submits an engineering report on their integrity.
Jennifer Towers Apartment Corp., owned by real-estate mogul Fraydun Manocherian, has $10,750 in outstanding fines for failing to properly inspect the building's exterior walls and balconies."
This could represent a clear case of liability on the part of the buidling owners.
