Staten Island DUI Accident Takes Life of Woman

Accidents Injury Blog

Written by New York Injury Lawyer Monday, 12 July 2010 17:09

Despite billions of dollars being spent nationally on campaigns designed to curb the always-wrong practice of drinking and driving, people still make the decision to do just that.  Unfortunately, many of the results of these decisions are tragic, and that's exactly what appears to have occurred on Saturday in Staten Island, where a woman was violently killed by an alleged drunk driver as she stood near her broken-down vehicle just blocks from her home.

According to police, this New York DUI accident occurred just before 3 a.m. on Saturday morning at the intersection of Targee St. and Laurel Ave.  The woman, Brunilda Maldonado, 47, got out of her vehicle to see what was happening after it stalled.  Soon thereafter, another driver stopped in order to help.  Just then, a Toyota sedan came speeding down Targee St. and slammed into Ms. Maldonado.  The force of the impact was so severe that she was knocked out of her shoes and had her hat sent flying.  She was killed instantly.

The driver, who was later identified as 19-year-old Daniel Lozano, attempted to flee the scene, but he was soon tracked down and arrested.  The preliminary charges include DWI and leaving the scene of an accident, although it's clear that he will soon face much more significant criminal charges.

New York Car Accident Statistics

First, we'd like to extend our condolences to the family and friends of Ms. Maldonado.  To lose a life in such a sudden and violent manner is nothing short of tragic, and we hope that those who were close to her are able to overcome what is certainly a tremendous amount of shock.  Secondly, this latest New York DUI accident will only become part of the overall statistics kept in this regard.  Every year, more than 300,000 New York car accidents take place, killing more than 1,200 people.  Of those 300,000 almost 9,000 New York car accidents involve alcohol.

While the defendant will certainly face tremendous scrutiny from authorities, it's also possible for the family of the victim to file a New York wrongful death lawsuit.  If the claim is successful, damages could be awarded to the family for funeral, burial and medical costs as well as lost income and loss of companionship.  However, these determinations should only be made with the help of New York wrongful death lawyers who have been holding those responsible for these types of losses for almost 40 years.  Contact Fitzgerald & Fitzgerald today to schedule a free initial consultation.

New York DUI Accident Leaves Both Drivers in Critical Condition

Accidents Injury Blog

Written by New York Injury Lawyer Thursday, 08 July 2010 18:34

The 4th of July weekend is one that's filled with celebrations, relaxation and time with family and friends.  Unfortunately, it's also a time when too many people make the always-bad decision to drink and then to get behind the wheel of a vehicle.  Apparently, this appears to be what police are alleging after a suspected New York DUI accident took place in the early morning hours of Monday that left the drivers of both vehicles in critical condition.

According to police, this suspected New York DUI accident took place just after 6 a.m. when Dave Richards, 30, of Hempstead, Long Island was driving his Mercedes in the wrong direction on the Long Island Expressway near the Utopia Parkway at Exit 25.  As a result, his vehicle slammed into a shuttle van head-on that was being driven by John Rey, 64, of Greenlawn.  Immediately after the crash, both vehicles burst into flames and both drivers had to be rescued.  Both were sent to the hospital in critical condition, and the blood alcohol content of Mr. Richards was measured at 0.19, which is more than twice the legal limit in New York.  Mr. Richards has since been charged with reckless endangerment and driving while intoxicated and with a suspended license.

New York Car Accident Statistics

First, we'd like to extend our hopes that both people who were injured are able to recover from their injuries, and both were fortunate to survive such a horrific crash.  Additionally, this latest suspected New York DUI accident will only add to the total statistics that are kept in this regard.  Every year in New York, more than 300,000 car accidents take place, leading to almost 200,000 injuries and more than 1,200 deaths.  Of those New York car accidents, almost 9,000 list alcohol as a contributing factor, and these crashes lead to almost 5,000 injuries and more than 150 deaths.

New York DUI Accident Lawyers

Clearly, Mr. Richards will face significant scrutiny from the District Attorney.  In addition, it's possible that Mr. Rey could file a New York personal injury lawsuit.  If the claim proves successful, Mr. Rey could be awarded damages for medical expenses, pain and suffering and lost income depending on the specifics of the case.  If you or someone you love has been harmed in such an incident, you need the help of New York car accident lawyers who have been holding drunk drivers accountable for the injuries they've caused for nearly 40 years.  Contact Fitzgerald & Fitzgerald today to schedule a free initial consultation.

Written by New York Injury Lawyer Wednesday, 30 June 2010 18:50

Motorcycles are extremely popular this time of year, as the weather is conducive to this form of transportation and these smaller vehicles can make navigating and maneuvering through congested traffic much easier than for those in larger vehicles.  However, motorcycles are also dangerous for those who drive and ride them, and that reality was tragically reinforced early last Friday morning when two people were killed in another fatal New York motorcycle accident.

According to police, the accident took place at approximately 12:30 a.m. on Friday morning at the intersection of Quentin Road and East 38th Street in Marine Park.  A 22-year-old man was driving his Kawasaki motorcycle with a 21-year-old female passenger down Quentin Road when he slammed into the side of a Nissan Altima that was moving along on East 38th Street.  Both people on the motorcycle were thrown from the bike and died later at the hospital.  Witnesses stated that the motorcycle was moving at a very high rate of speed.  The driver of the Nissan was not charged in the incident.

Accidents Injury Blog

Written by New York Injury Lawyer Monday, 28 June 2010 10:52

Drinking and driving is never a good decision, and the 'lucky' ones who engage in this conduct do so without getting arrested or causing harm to themselves or others.  Tragically, this sort of alleged bad decision did not end well at all for the driver of a vehicle or her passenger over the weekend when a one-car Bronx DUI accident took the life of a passenger in a vehicle that was being driven by someone who is suspected of driving under the influence.

The latest fatal New York car accident took place on Sunday morning at approximately 12:30 a.m. when 29-year-old Maria Lara was driving her Saturn vehicle on the Hutchinson River Parkway in The Bronx near near the Orchard Beach exit.  For some reason, the vehicle slammed into the guard rail, spun completely off the road and slammed into a nearby tree at what's believed to be a high rate of speed.  The passenger, whose name is being withheld pending notification of family members, died at the scene.

Lara was taken to a nearby hospital for treatment of her injuries, and she is listed in stable condition.  She has also been charged with charged with manslaughter, vehicular manslaughter and driving while intoxicated.  These are clearly very serious charges, and she could face significant prison time if convicted depending on certain factors including any prior record that she has.

Worker Dies in New York Construction Accident

Accidents Injury Blog

Written by New York Injury Lawyer Saturday, 26 June 2010 12:04

Construction workers endure long days of grueling labor, and most of them must also deal with dangerous conditions that include working with and around heavy equipment and materials.  One of the many reasons that construction workers face more danger than most other professions is because if anything at all goes wrong, the results can be disastrous.  Tragically, that appears to be what occurred yesterday when a contractor working for the MTA was killed under a crush of subway station panels.

The incident took place at approximately 8:20 a.m. yesterday when a driver working for the trucking company Preferred Transit delivered a load of these subway station panels to to the Avenue M station on the B and Q lines in Brooklyn.  When the man, whose name was not released pending notification of his family, climbed on top of the truckload of these panels to untie and unload them, he realized that they were loose and unsafe.  He jumped off the pile, but it was too late.  After he landed on the ground, several panels fell after him and crushed him instantly.  Each of these panels weighs an estimated 1,000 pounds.

Fatal Construction Accident Statistics

First and foremost, we'd like to extend our condolences to the family and friends of the worker who was killed.  This is no way to leave the world, and we hope that his family and friends are eventually able to overcome the grief and sorrow that they're certainly feeling.  Secondly, this incident will only add to the statistics regarding fatal construction accidents in the United States.  Every year, more than 1,000 private construction workers are killed in construction site accidents, and the private construction industry remains the industry with the highest death rate in the industrialized sector of jobs.

New York Wrongful Death Lawyers

Based on statements given by police, it appears that the mistake made here was overloading the truck and failing to tie the load down properly.  If it turns out that the driver was not responsible for the security of this load, it's possible that his family could bring a New York wrongful death lawsuit against those responsible.  However, this decision should only be made with the help of New York wrongful death lawyers who have years of experience in successfully fighting for the rights of aggrieved families.  Contact Fitzgerald & Fitzgerald today to schedule a free initial consultation.

Staten Island Ferry Accident Caused by Defective Part

Accidents Injury Blog

Written by New York Injury Lawyer Monday, 21 June 2010 18:30

We posted recently regarding a Staten Island Ferry accident that led to dozens of injuries.  At the time and as is typical in the aftermath of these types of accidents, several levels of government got involved with the investigation in order to determine a cause for the accident.  The investigation was led by the National Transportation Safety Board, or the NTSB, and it recently concluded the investigation regarding this incident.  It concluded that a defective part was to blame for a collision with the dock.

The specific part that was defective involved the intricate propulsion system that was not responding properly to commands from the wheelhouse.  As a result, the Andrew J. Barberi slammed into the dock injuring dozens of people on May 8 of this year.  The conclusion was drawn when the parts in question were replaced and the subsequent tests revealed that the issue was no longer a danger.  However, it should be noted that the government has not yet issued what it considers a 'final' report on the cause of the crash, even though it seems clear that the problem has been identified.

New York Personal Injury Lawyers

Assuming that the defective part was responsible for the injuries caused in the accident, it could give rise to New York personal injury lawsuits that are brought by those who were harmed in the Staten Island ferry crash.  However, there would be questions that need to be answered before such a lawsuit was filed.  For instance, potential plaintiffs would need to know whether or not the defective part should have been discovered by those responsible for the ferry or whether the part manufacturer was responsible for the placement of a defective part into the market stream.  Of course, both parties could be liable depending on the facts.

Regardless, this type of analysis should be done with the help of experienced New York personal injury lawyers.  If you have been harmed in this or any other accident, seek the help of attorneys who have been getting to the bottom of complicated scenarios for almost 40 years.  Contact Fitzgerald & Fitzgerald today to schedule a free initial consultation.

New York Lead Paint Poisoning Remains an Issue

Accidents Injury Blog

Written by New York Injury Lawyer Saturday, 19 June 2010 10:45

A common joke that exists is for one person to ask another if he or she ate paint chips as a kid.  While humor can lighten almost any situation, the fact of the matter is that paint chips have been and continue to be a danger for people all over New York because of the lead present in older house paints.  Efforts are underway around the state to help eliminate the presence of lead-based paint, but that has not and will not eliminate the need for legal help for those who have suffered from lead poisoning because of their exposure to this substance.

Lead Paint Poisoning - How it Occurs

Lead-based paint is a product that used to be extremely common, but after it was discovered that exposure to this paint could be dangerous, its use dissipated.  Basically, any home or structure built before 1978 that has not had its old paint removed could still expose people to lead and its aftereffects.  These lead paint side effects can be extremely dangerous for anyone who is exposed to the lead for too long or at levels that are too high.  This is particularly true of children who tend to eat paint and stick their hands or other objects that have paint dust on them in their mouths.

Lead Paint Poisoning - The Harm

Lead paint poisoning occurs over time, and the medical result is that the blood contains elevated levels of lead.  The United States Centers for Disease Control and Prevention estimates that almost 900,000 children between the ages of one and five have elevated levels of lead in their blood, and these elevated levels can lead to:

  • Damage to the central nervous system
  • Damage to the brain
  • Damage to the circulatory system

Any of these problems can be severe and in many cases permanent.

New York Lead Poisoning Lawyers

In addition to the problems lead-based paint can cause, those who are responsible for exposure to this harmful substance could be liable for damages in certain situations.  If you or someone you love has suffered from the effects of exposure to lead-based paint, you need the help of New York personal injury lawyers who understand how to hold parties responsible for harm properly accountable.  Contact Fitzgerald & Fitzgerald today at 800-323-9900 to schedule a free initial consultation.

Bronx Hit-and-Run Accident Costs Motorcyclist His Leg

Accidents Injury Blog

Written by New York Injury Lawyer Friday, 11 June 2010 14:44

There are many reasons that someone would try to explain in regards to why they fled the scene of an accident.  Perhaps they had a negative driving record.  Perhaps they were concerned about paying damages.  Regardless of their reasons, however, none of them are good or worthwhile.  Sadly, another New York hit-and-run case occurred yesterday in the Bronx when a motorcyclist was hit by a truck and lost his leg as a result.  The driver of the suspect vehicle then fled the scene.

The latest New York motorcycle accident took place just after 3:30 p.m. on Bruckner Blvd.  The biker was driving his O'Neal 1255 SX dirt bike down the street just as a box truck was attempting to beat the light that controlled the intersection between Bruckner Blvd. and E. 149th St.  According to witnesses, the box truck ran through a red light and the driver slammed into the motorcycle, throwing the driver off of the vehicle.  The victim, whose identity has not been released, suffered a severed leg as a result of the incident and was rushed to a nearby hospital.  Police are still searching for the driver of the box truck.

New York Motorcycle Accident Statistics

First, we'd like to extend our thoughts towards the man on the motorcycle.  We hope he is able to overcome this injury as many have before and to get on with his life in a positive manner.  Unfortunately, this incident will also become the latest entry in the statistical body of data regarding New York motorcycle accidents.  Every year, more than 5,000 New York motorcycle accidents take place, leading to almost as many injuries and several hundred deaths.

New York Motorcycle Accident Lawyers

If the driver in this incident is ultimately apprehended - and the majority of hit-and-run drivers are caught - the man on the motorcycle could bring a New York personal injury lawsuit against the box truck driver in addition to the likelihood of criminal prosecution.  If such a lawsuit was successful, he could recover damages that include medical costs, long-term medical and equipment costs, lost income and pain and suffering.  However, cases like these should only be filed with the help of New York motorcycle accident lawyers who have years of experience in holding those who create this sort of harm accountable.  Contact Fitzgerald & Fitzgerald today at 800-323-9900 to schedule a free initial consultation.
